M Hawk Co. Global Terms of Service & Return Policy

1.0 Limitation of Liability and Corporate Entity Structure

All transactions, guarantees, and services provided through this website are executed strictly by and through M Hawk Co. ("Company"). M Hawk Co. operates as an independent legal entity. By engaging in any transaction, the purchaser ("You") explicitly agrees that all liability, obligations, and claims arising from the purchase, delivery, or use of the products lie solely with M Hawk Co. No individual founder, creator, or associate of M Hawk Co. shall be held personally liable for any claims, damages, or disputes.

2.0 The M Hawk Co. Guarantees

2.1 Scope of the 66-Day Guarantee

M Hawk Co. extends a conditional sixty-six (66) day limited money-back guarantee to the original end-user purchaser of physical apparel items. The Guarantee period strictly commences on the date of confirmed delivery as recorded by the designated courier.

2.2 Waiver of Physical Return

Subject to the strict limitations outlined in Section 2.3, if a purchaser expresses dissatisfaction with the merchandise within the 66-day period, M Hawk Co. shall issue a refund to the original method of payment. M Hawk Co. waives the requirement for the purchaser to physically return the merchandise.

2.3 Strict Limitations and Fraud Mitigation

To prevent fraud and policy abuse, this Guarantee is contingent upon the following:

Quantity Limitation: The waiver of physical return (Section 2.2) is expressly restricted to a maximum of one (1) single unit per purchaser, per household, for the lifetime of M Hawk Co. Any subsequent refund requests, or requests involving multiple items within a single transaction, mandate the physical return of all merchandise in its original condition at the purchaser's expense prior to refund issuance.

Exclusion of Ancillary Costs: This Guarantee applies solely to the principal purchase price of the merchandise. All original shipping fees, expedited transit charges, and applicable international customs or import duties are strictly non-refundable.

Chargeback Forfeiture: The initiation of a payment dispute or chargeback with a financial institution prior to initiating a formal claim with M Hawk Co. support immediately nullifies and voids this Guarantee.

Right of Refusal: M Hawk Co. reserves the unilateral right to investigate, deny, or revoke Guarantee claims, and may permanently refuse service to any individual or household reasonably suspected of engaging in policy abuse or fraudulent activity.

2.4 The M Hawk Co. 30-Day Fulfillment Guarantee (The "Gift" Clause)

M Hawk Co. holds its production and fulfillment to the highest standard. If your physical order is not manufactured, dispatched, and handed over to the courier within thirty (30) days of the original purchase date, M Hawk Co. will automatically initiate a full, 100% refund of your purchase price to the original payment method.

Upon issuance of this refund, the commercial transaction is considered complete and closed. However, as a commitment to our craftsmanship, M Hawk Co. will seamlessly convert the original order into a complimentary gift. The requested product will still be manufactured and shipped to you globally at absolutely no cost.

3.0 International Statutory Rights & Regional Compliance

This 66-Day Guarantee is a commercial warranty provided in addition to, and does not affect, your statutory rights under applicable local and international consumer protection laws.

3.1 For Consumers in the European Union (EU) & United Kingdom (UK)

Right of Withdrawal: You have the statutory right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire 14 days from the day on which you acquire physical possession of the goods.

Refunds under Withdrawal: If you exercise your statutory right of withdrawal, we shall reimburse all payments received from you, including the costs of standard delivery, without undue delay and not later than 14 days from the day we are informed of your decision to withdraw. You are responsible for the direct cost of returning the goods.

Pre-Contract Information: By completing checkout, you acknowledge your obligation to pay.

3.2 For Consumers in Australia

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

3.3 For Consumers in the United States

Shipping & Delivery: M Hawk Co. will make all reasonable efforts to ship items within the timeframe displayed at checkout. If an unexpected delay occurs resulting in a shipping time exceeding 30 days from the date of order placement, you will be notified and given the option to consent to the delay or cancel your order for a prompt, full refund in compliance with FTC regulations.
